Terms of service.

1. Who we are

Questy is a live quiz game at questy.io, run by Questy LLC, a Colorado limited liability company ("Questy", "we"). When you use Questy you agree to these terms.

2. Two kinds of people use Questy

• Account holders sign in with an email address to write quizzes and run games. You must be at least 18. If you use Questy for a school or an employer, you agree to these terms on its behalf and confirm that you are allowed to.
• Players join a game with a PIN, a nickname and a character. Players do not create an account. Whoever runs a game is responsible for the people they invite to play it, including any permission needed for children to take part.

3. Your account

Your account is for you alone. Keep your sign-in email and any password secure: you are responsible for what is done under your account. Tell us at once if you think someone else has used it.

4. What you may not do

• Break the law, or use Questy to harass, deceive or harm anyone.
• Add content you have no right to use.
• Put personal information about children or other private people into quizzes, nicknames or uploaded files.
• Try to break, overload or probe Questy, or to get around its limits.
• Create accounts or join games by automated means.
• Resell Questy or offer it to others as your own service.

We may remove content or suspend an account that breaks these rules. We will tell you why unless the law prevents it.

5. Your content

The quizzes you write and the files you upload remain yours. You give us permission to store, copy and show them only as far as needed to run Questy for you: for example to show your questions to your players and to keep your game history.

If you turn on a share link for a quiz, anyone with the link can see a preview and take their own copy. A copy someone has already taken stays theirs when you turn the link off.

The ready-made quizzes in the Questy library are ours. You may play them in your games and change your own copies. You may not republish them elsewhere.

6. The AI quiz maker

The AI quiz maker drafts questions from a description or from material you give it. AI makes mistakes. Read every question and check every answer before you use a draft: you are responsible for the quizzes you run.

Do not give it material you are not allowed to share, or material that names pupils or shows their marks. The number of drafts you can make is shown in the product and depends on your plan.

7. Plans and payment

• Questy has a free plan, paid plans billed by the month or by the year, and a one-time event pass. The price is shown before you pay.
• A paid plan can be tried free for 30 days, once per account, without giving a card. If a card has been added by the time the trial ends, the paid plan starts that day. If none has, the plan stops by itself and the account goes back to the free plan.
• Payments are taken on Stripe's own pages and sold through Link, a Stripe service, which charges your card and adds any sales tax that applies. The total, tax included, is shown before you pay, and Link's own terms apply to the payment itself. We never see or store card numbers.
• A paid plan renews at the end of each period until you cancel. You can cancel at any time in Settings, under Your plan. The plan then runs to the end of the period you have paid for.
• An event pass is one payment. It lasts 48 hours from when it is bought and does not renew.
• Refunds: a first yearly payment is refunded in full if you ask within 14 days of paying. Otherwise we do not refund part of a period, except where the law requires it. To ask, write to us from Settings, Help, or through the contact page.
• We may change prices. We will email you at least 30 days before a new price applies to your renewal.
• If a payment fails and is not put right, the account goes back to the free plan. Nothing you have made is deleted.
• Plus that we give without payment (free AI drafts, a month earned by an invitation, a school unlock) has no cash value, and we may change or end those offers.

8. Schools and organisations

A school, district or company that needs a signed agreement, a data protection agreement or an invoice should write to us. Where a signed agreement and these terms disagree, the signed agreement applies.

9. Changes to Questy

We work to keep Questy running, but we do not promise that it will always be available or free of faults. We may add, change or remove features. If we remove something you have paid for, we will refund the unused part of what you paid.

10. Ending

You can stop using Questy at any time, and delete your account yourself in Settings, under Privacy. We may suspend or close an account that breaks these terms. We may also close an account for any other reason with 30 days' notice and a refund of the unused part of anything prepaid.

11. What Questy is not

Questy is a game. Quiz content, including the library and AI drafts, may contain mistakes. Do not use Questy as the only record for grades or for any decision that matters about a person. To the extent the law allows, Questy is provided as it is, without warranties.

12. Limit of liability

To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to the amount you paid us in the 12 months before the claim, or US$50 if you paid nothing. Nothing in these terms limits liability that the law does not allow to be limited.

13. Law and disputes

These terms are governed by the law of the State of Colorado, USA, and disputes go to the state or federal courts located in Colorado. If you use Questy as a consumer, this does not take away any protection that the law of the place where you live gives you and that cannot be given up by agreement.

14. Changes to these terms

We will post changes on this page. For a change that matters, we will email account holders at least 30 days before it takes effect. Using Questy after that date means you accept the change.
